1. Acceptance of Terms

By accessing or using the Grabbev mobile application (“App”) or website, you agree to be bound by these Terms and Conditions (“Terms”), which govern your use of the services provided by Grabbev. If you do not agree, please do not use the platform.

2. Legal Framework

This agreement is governed under the Information Technology Act, 2000, and rules thereunder, including but not limited to:

  • The Consumer Protection Act, 2019

  • The Motor Vehicles Act, 1988 (as amended in 2019)

  • The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021

Grabbev operates as an intermediary platform, facilitating transport services between registered users and independent driver-partners.

3. Services Provided

Grabbev is a digital platform that connects users seeking transportation with independent third-party driver-partners. Grabbev does not own, operate, or control any vehicles and is not a transport provider as defined under the Motor Vehicles Act.

4. Eligibility

  • Riders must be 18 years of age or older.

  • Drivers must possess:

    • Valid Indian Driving License

    • Vehicle with a valid Permit and Insurance

    • Commercial Registration (as required under MV Act)

    • Aadhaar and PAN (for KYC compliance)

5. User Account Registration

Users and Drivers must:

  • Provide valid and verifiable contact details.

  • Maintain the confidentiality of their login credentials.

  • Agree that all activities conducted through the account are their sole responsibility.

6. Ride Booking and Payment

  • Fare estimation is dynamically calculated based on time, distance, traffic, and demand.

  • Payment modes include UPI, debit/credit card, net banking, and cash.

  • GST (Goods and Services Tax) is applicable as per Indian taxation laws.

  • Invoices will be generated digitally and made available via the app.

7. Cancellation and Refund Policy

  • Cancellation by user or driver may attract a nominal fee.

  • Refunds are processed within 7 working days, if applicable.

  • Refund claims must comply with the Consumer Protection (E-commerce) Rules, 2020.

8. Driver-Partner Terms

Drivers:

  • Operate as independent service providers, not employees.

  • Must comply with RTO and transport department regulations.

  • Must complete KYC and background verification as per company policy.

  • Are responsible for vehicle maintenance, safety, and passenger well-being.

9. Safety and Conduct

  • Grabbev follows the Ministry of Road Transport and Highways safety guidelines.

  • Riders and Drivers are expected to behave respectfully.

  • Discrimination, harassment, or abuse will lead to account suspension.

  • Emergency assistance tools, GPS tracking, and SOS features are provided for user safety.

10. Grievance Redressal

In compliance with Indian laws, Grabbev has appointed a Grievance Officer:

11. Limitation of Liability

Grabbev shall not be held liable for:

  • Acts or omissions of third-party drivers or users.

  • Loss of personal belongings during trips.

  • Any personal injury or property damage not caused by Grabbev’s gross negligence.

12. Data Protection and Privacy

User data is handled as per the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

  • User data is collected with consent.

  • Stored securely on Indian or RBI-compliant cloud infrastructure.

  • Not sold to third parties without consent.

13. Intellectual Property

All content on the platform (logos, UI/UX, text, software, etc.) is owned or licensed by Grabbev. Users may not reproduce or use any part without written permission.

14. Modification of Terms

Grabbev reserves the right to modify these Terms. Continued use after modifications implies acceptance.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of the courts of [Your Registered Office City, India].
